This website (aquavial.shop) is operated by ExactBlue Inc. Throughout this document, the terms "we", "us", and "our" refer to ExactBlue Inc. We offer this website, including all information, tools, and services available through it, conditioned on your acceptance of the terms, conditions, policies, and notices stated here.

By visiting our website or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced here or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, and customers.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that lets us sell our products to you.

1. Eligibility and online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or country of residence, or that you have the consent of a parent or guardian.

You may not use our products for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction in the course of using our Service.

You must not transmit any worms, viruses, or any code of a destructive nature in connection with your use of the site.

2. Product information and use

AquaVial test kits are screening tools designed to indicate the presence of microbiological contaminants (such as total coliform bacteria, E. coli, and Pseudomonas aeruginosa) in water samples. They are intended for general consumer use.

Important: AquaVial kits provide presence/absence screening results. They do not replace certified laboratory testing for regulatory compliance, medical diagnosis, or treatment decisions. If you receive a positive result or have a serious water-quality concern, we recommend confirming with a certified laboratory and consulting your local public health authority. We make no medical claims and do not provide medical advice.

Product specifications, instructions for use, and shelf-life information are provided on each kit and on the corresponding product page. Always follow the instructions for use to obtain accurate results.

3. Pricing and order acceptance

All prices are listed in US dollars unless otherwise stated. Prices and product availability are subject to change without notice.

We reserve the right to refuse or cancel any order, including orders that appear to be placed by automated systems, orders for resale, or orders with billing/shipping inconsistencies. If we cancel an order after payment is made, we will issue a full refund to the original payment method.

We make every effort to display product images and descriptions accurately, but we cannot guarantee that your monitor's display of any color will be precise.

4. Accuracy of billing and account information

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to update your account information promptly if it changes (email, billing/shipping address, payment method) so we can complete your transactions and contact you as needed.

5. Returns and shipping

Returns, refunds, and replacements are governed by our Refund & Returns Policy. Shipping is governed by our Shipping Policy. Both are incorporated into these Terms by reference.

6. Personal information

Your submission of personal information through the site is governed by our Privacy Policy.

To the fullest extent permitted by law, ExactBlue Inc., its directors, officers, employees, contractors, and suppliers will not be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or our products. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

These Terms and any separate agreements by which we provide you services are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles.
